PREFERRED CUSTOMER PROGRAM REGULATIONS
HOSPITAL CLÍNICA BÍBLICA
1.General Provisions
This preferred customer program belongs to the ASOCIACIÓN SE SERVICIOS MÉDICOS COSTARRICENSES, hereinafter called ASEMECO, owner of the “Hospital Clinica Biblica” registered trademark.
Participants in this program will be Hospital Clinica Biblica users who meet the requirements set forth in this instrument. ASEMECO reserves the right to include other beneficiaries at its discretion.
Any person who participates in this program will do so with the understanding that they accept and submit to the following conditions and limitations and any modifications that may be made to these regulations.
ASEMECO reserves the right to modify or partially or fully cancel, as it deems necessary, the regulations, rules, privileges, benefits and rewards of the same.
It is essential for the cardholder to strictly adhere to the special or preferential treatment conditions that each card sets for members of the Preferred Customer Program.
ASEMECO reserves the right to change discounts or special offers of the Preferred Customer Program.
The Preferred Customer Program is a personalized program. Correspondence and advertising material concerning the program will be sent to the address indicated in each member’s membership document, or will be communicated by means of telemarketing, e-mail, regular mail, or any other communication means acceptable to the beneficiary.
The cardholder will be responsible for notifying the HOSPITAL CLÍNICA BÍBLICA of any change of address, post office box, e-mail address or telephone number to guarantee proper information flow between the parties.
2. Definitions
ASEMECO: This is the name used for the Asociación de Servicios Médicos Costarricenses in these regulations.
Program: Preferred Customer Program; mechanism by which those persons who make frequent use of Hospital Clinica Biblica services and meet the requirements specified herein can obtain additional benefits.
Card: Identification card granted by ASEMECO to customers in the Hospital Clinica Bíblica’s Preferred Customer Program. They are identified with different colors: blue (Classic card), gold (Gold card) and platinum (Platinum card).
Cardholder: Owner of only one of the three types of Preferred Customer cards who has entered the program and enjoys the respective benefits.
Doses: Advantage obtained by cardholders in the Preferred Customer Program for using Hospital Clinica Biblica outpatient and hospitalization services.
Points: Sum of the doses obtained for using Hospital Clinica Biblica services during a specific period.
Promotions: Activities for specific periods carried out by the Hospital Clinica Biblica that award doses or other additional benefits.
Benefits: Sum of the doses accumulated by cardholders when using the goods and services provided by ASEMECO through the Hospital Clinica Biblica which are awarded through discounts applicable according to the card they hold.
3. Duration
This program will be in effect for a period of two years as of September 30, 2007.
The information in these regulations will be in effect as long as they are not superseded by new regulations.
4. Picture Rights
By using the benefits of the PREFERRED CUSTOMER Program, the cardholder authorizes HOSPITAL CLINICA BIBLICA to publicize, if it deems proper, their name and photographs in advertising for the program, and the cardholder waives the right to collect picture rights to this respect.
5. Doses and Point Changes
ASEMECO reserves the power to correct, eliminate or discount from the cardholder’s accounts any purchases or doses that have been erroneously accredited.
ASEMECO reserves the power to award purchases or complementary doses on the occasion of specific promotional campaigns.
6. Membership
To join the Preferred Customer Program a customer must make a minimum purchase of $200.00 (two hundred dollars, legal tender of the United States of America).
The following spending amounts shall be in effect for granting the cards:
- $200.00 (two hundred dollars) to $500.00 (five hundred dollars): Classic Preferred Card
- b) $501 (five hundred and one dollars) to $1,000 (one thousand dollars): Gold Preferred Card
- c) $1,001 (one thousand and one dollars) and over: Platinum Preferred Card
These memberships will be for a period of one year. The cardholder will be able to go up a level from one card to another when he/she reaches the minimum amount of purchases set for the new card. This amount shall not be accumulative; it is an annual average of the purchases that the cardholder must make. Acquiring the benefits of the new card will automatically mean relinquishing those of the previous card while retaining the doses accumulated to date.
If the customer complies by making the minimum purchase ($200) to obtain a card and continues to be active within one of the categories, the customer will acquire membership in the PREFERRED CUSTOMER Program for one year from when his/her membership is accepted. ASEMECO has up to eight business days to announce acceptance of the membership as of the application date of the same.
The participation of any employee of the following corporations shall be excluded from the Preferred Customer Program: ASEMECO, ANVECO S.A., SITERE, ASERSA S.A. Likewise excluded from participation in this program are the professionals and companies rendering their services to or within any of the aforementioned corporations in this clause.
ASEMECO reserves the power to review members’ accumulated monthly purchase volumes in order to guarantee the levels they justify and extend the members’ participation in the program pursuant to regulations.
A member’s participation in the program can be suspended until a satisfactory solution has been found for any detected discrepancy or anomaly.
ASEMECO reserves the power to terminate the membership of any cardholder who, in the opinion of ASEMCO, has committed any fraud, abuse or infringement of any of the natural purchase, benefit usage or reward usage procedures, or of any other point in the program regulations. A disqualified cardholder will lose all his/her membership rights. All of the foregoing shall be without prejudice or waiver on the part of ASEMECO to judicial or extrajudicial actions that it may initiate, depending on the damages occasioned.
If a cardholder renounces his/her card, he/she will automatically lose the right to their accumulated purchases or doses, which shall not be transferable to any other cardholder. Renouncement is understood as when a cardholder applies for membership withdrawal in writing, or when they have not used their PREFERRED CUSTOMER card for a period of over twelve months.
7.Card
All new program members will receive a card identifying them as a Preferred Customer. In case of loss or deterioration of this card, the program member must pay a fee of three dollars ($3.00) to replace it; replacement will be made two business days after it is requested.
The discounts granted by the card can be requested by the bearer of the same; any other additional benefit, however, must be requested by the cardholder, who must present a valid card and his/her identification card. The accumulated doses for each card are not transferable to third parties; neither can they be used after their expiration date.
HOSPITAL CLÍNICA BÍBLICA reserves the right to include a new card or combine this card with other credit or debit cards associated with the Preferred Customer Program.
8.Dose Accumulation and Discounts
One dose will be accumulated for each dollar ($1.00) spent on outpatient services or hospitalization services at the Hospital Clinica Biblica, with the exception of the Pharmacy, where one dose will be assigned for every two dollars ($2.00) of each purchase.
As of the moment in which the cardholder first presents their Preferred Customer card, and every time they present it when using a Hospital Clinica Biblica service, they will accumulate doses to their personal account. Doses are accumulated at the rate of one dose per dollar ($1.00) purchase of outpatient and hospitalization services, with the exception of the pharmacy, where one dose will be assigned for every two dollars ($2.00) of purchases.
The Classic card will apply solely for the accumulation of doses and a 5% discount on all Hospital Clinica Biblica services (outpatient and hospitalization).
The Gold card will allow for dose accumulation and application of a 10% discount on outpatient services and 5% on hospitalization services proper.
The Platinum card, in addition to dose accumulation, will award 15% discounts on outpatient services and a 7.5% discount on hospitalization services proper, in addition to an annual Preferred Customer medical check-up.
HOSPITAL CLÍNICA BÍBLICA reserves the right to implement projects and promotions for all or some cardholders that will allow them to obtain benefits in addition to those established in these regulations.
In the case of promotions where discounts are offered for specific services or for a specific period, packages, insurance, business agreements or promotions, the discount offered by the Preferred Customer card cannot be applied, regardless of the category.
Dose accumulation is applicable to all types of insurance, agreements, or other promotions carried out by ASEMECO.
ASEMECO will use an average of the selling exchange rate of Banco Costa Rica, Banco HSBC and Banco BAC San José for calculating dollars with respect to colones.
9.Dose Exchange
A minimum accumulated total of one thousand (1,000) doses within a maximum period of six months is needed in order to apply its equivalent in colones through the money return discount system.
Each dollar in purchases of Hospital Clinica Biblica services is equivalent to one dose; to exchange doses for hospital medical services each dose is equivalent to two cents ($.02).
The account statement for each Preferred Customer Program member, as well as promotions or other offers, will be communicated by means of an informative bulletin. ASEMECO reserves the right to change the benefit conditions offered by the program; this is understood and accepted by its beneficiaries.
The cardholder may use the program card without limit during the year in which it is valid. That is to say, there is no minimum or maximum number of times the card can or should be used, as long as it is valid.
10.Final Provisions
If ASEMECO must withdraw the program before it expires, it shall be understood that ASEMECO assumes no liability whatsoever for the rewards or benefits that have not been exchanged at the date in which the program is withdrawn.
The rights stipulated in this contract cannot be transferred, assigned, encumbered or alienated in any way in favor of third parties.
11. Revocation
These regulations supersede any previous regulations and HOSPITAL CLÍNICA BÍBLICA shall not be liable for the changes this may imply for users of the previous program.
